Registration advice form

The registration advice form that has to be filled in by the applicant of the registration is a deed drafted on paper support or by electronic media. 
Registration advice forms based on which are performed the registrations with the Archive for Security Interests in Movable Property - AEGRM are comprised in Appendixes 1 - 26 to Order no. 2034/C from 10 October 2011 for the approval of the registration advice forms on the registrations performed with the Archive for Security Interests in Movable Property - AEGRM.

For each registration advice is established a distinct form, except the registration advice on the intent to set up a security mortgage for the registration of which is used the initial security mortgage advice form.

How do you fill in a registration advice form?

The registration advice form that has to be filled in by the applicant of the registration is a deed drafted on paper support or by electronic media. 
The registration advice forms based on which are performed the registrations with the Archive for Security Interests in Movable Property - AEGRM are comprised in Appendixes 1-26 to Order no. 2034/C from 10 October 2011 for the approval of the registration advice forms regarding the registrations performed with the Archive for Security Interests in Movable Property - AEGRM.

For each registration advice is established a distinct form, an exception being the registration advice of the intent to set up a security interest for the registration of which is used the initial registration advice form.

The form on paper support has to be filled in by the applicant in double counterpart¹ and signed by him. 
The person whose identification data are provided in the introductory part of the form should be the same as the one filling in and signing the form and addressing the application for the registration with the Archive for Security Interests in Movable Property - AEGRM.

The operator shall not verify whether the form was indeed subscribed by the concerned individual, as the law does not impose that such operation should be performed under the control of the operator/agent, but he shall verify whether the identification data provided in the introductory part of the form are similar to the ones recorded in the ID card of the applying individual.

The data comprised in the form presented on paper support may be filled in also by using adequate IT applications, but the signature should be in own handwriting.
The applicant shall certify by signature any amendment of the data from the registration advice form (amendments, supplementations, etc.) and columns that are not filled in shall be barred.
The operator/agent shall refuse to perform registrations with the Archive for Security Interests in Movable Property - AEGRM if the applicant of the registration supplies incomplete data (for example incompletely identifies one of the parts from the registration advice or does not correctly describe the asset subject to the security mortgage by omitting certain mandatory elements, such as the engine series, the chassis number, etc. in case of vehicles).
If some of the columns of the form are not suffice in number for the registration of all information, the current columns within the form shall be multiplied by using adequate IT programs. 
Archive operators are under the obligation to ensure this service to the interested persons against cost or free of charge according to the own commercial strategies.
The registration advice form may appear also as a deed drafted by electronic media to which was incorporated, attached or associated the extended electronic signature of the concerned applicant based on a validly qualified certificate. 

In accordance with the law, the electronic transfer of documents - TED (inclusively of registration advice forms) between the applicants and authorized operators/agents may be performed as:

a) files attached to an e-mail, which have incorporated, attached or associated an extended electronic signature based on a valid certificate;
b) e-mail messages that have incorporated, attached or associated an extended electronic signature based on a valid certificate. The e-mail message shall include one single  registration advice form;

c) files remitted by techniques other than e-mail that have incorporated, attached or associated an extended electronic signature based on a valid certificate.

In view of using the TED, registration advice forms or other documents remitted to other operators/agents shall have an electronic format accepted by the Archive.

In regard to the remittal of the registration advice form in view of the registration with the Archive for Security Interests in Movable Property – AEGRM, the law regulates two methods of remitting/receiving the registration advice forms in view of the registration with the Archive for Security Interests in Movable Property – AEGRM. 
Thus, the registration advice form may be presented by the applicant in view of registering the operator or agent on paper support at the headquarters of the office for the registration with the Archive for Security Interests in Movable Property – AEGRM by the creditor or debtor, according to the law, or by their representative authorized by authentic proxy or lawyer by power of attorney for lawyers, when the representative is a lawyer. 
The form may be also remitted as a deed in electronic format to which was incorporated, attached or associated an extended electronic signature of the applicant based on a valid qualified certificate.

On receiving an electronic form, the operator/agent is under the obligation to verify the validity of the digital signature, the capacity of the person signing it and whether the content of the document is adequate.

The two methods of addressing an application for the registration with the Archive for Security Interests in Movable Property - AEGRM are restrictively established, enabling the doubtless identification of the applicant and thereon by verifying the data recorded in the form, of the proxy and of the ID card, the determination of the capacity of the interested person.
In accordance with the law, the recording of the registration advice forms with the Archive for Security Interests in Movable Property - AEGRM is an obligation and Archive operators are not entitled and cannot be compelled to take measures in regard to the accuracy of the information inserted with the Archive for Security Interests in Movable Property - AEGRM, the entire liability for the data recorded in the file being incumbent on the person requesting the performance of the registration.

¹ One counterpart of the form shall be returned to the applicant after performing the registration with the Archive on paper support, endorsed by the operator or agent, or in electronic format, as the case may be, signed with extended electronic signature of the operator or agent, by mentioning the number and date of registering the form, as well as the ID number of registration.
